RESERVATION CONDITIONS 1º Fill in all the fields in the reservation form and send it. (If you do not want to send your details by email for your personal security, you can print and fill in this form and send it by fax to our Reservation Department, Fax: 971 346 822) 2º Within 24 hours alter having received your reservation application, you will receive an email CONFIRMING YOUR RESERVATION with: - Detailed estimate - Reservation locator number - Instructions for your car's pick up. REQUIRED PAPERS TO PICK UP THE CAR -Valid driving license (minimum of 2 or 5-YEAR-EXPERIENCE depending on the reserved vehicle group*). -DNI or passport (Minimum age for reservation 21 or 25 YEARS OLD depending on the reserved vehicle group*). -CREDIT CARD -A copy of the "RESERVATION CONFIRMATION" with the locator number In the event that the driver does not fulfil any of the previous requirements the reservation will be automatically cancelled and he will be charged 1 rental day of the reserved vehicle. CANCELLATIONS -24 hours before the delivery date, without charge -After 24 hours before the delivery date, the total price of 1 rental day of the reserved vehicle. MODIFICATIONS For any modification send an email (info@autosportmany.com) or fax (971 346 822) with the reservation locator number, the new data, within a minimum of 24 hours prior to the delivery date of the vehicle. PAYMENT METHOD – CREDIT CARD Upon picking up the vehicle you will be charged with the total amount of the rental plus a deposit for the vehicle’s excess in your credit card. Upon returning the vehicle to the company, Portmany Eurocar S.L undertakes to return the payment for the excess if the vehicle has no damage at all. CLAUSES OF THE CONTRACT 1º STATE OF THE VEHICLE. The renter declares having received the vehicle in perfect conditions and with the statutory triangles and vest, being obliged to return it in the same conditions. The renter is responsible for the damages caused to the vehicle, as well as its theft or misplacement. 2º INSURANCE. The lessor offers the client a compulsory and liability insurance, plus another one for the occupants in the conditions stipulated by the insurance company. It also offers a personal accident insurance, plus a theft insurance, with an EXCESS, in the rented car. The loss, theft or damaged caused to goods or objects carried in the car are excluded from the coverage, as well as the damages caused to the vehicle due to theft and/or vandalism. The amount of the excess in the event of personal damage in the rented vehicle, theft, misplacement or loss of any of its pieces is detailed on the front of the contract, the renter will be able to exempt from the excess by paying the corresponding bonus, which is stated in the general valid rate. In no case does the exemption from the excess include the loss or break of the keys or the remote control (value between 80€ and 150€ depending on model), damages on the wheels, windows, accessories and extras of the rented vehicle and helmets (80€). If the client forgets or loses the keys, he will be charged 30€ for bringing him the copy of the keys. In case of accident the company will not replace the wrecked vehicle. The coverages in case of accident will not be applied if the renter does not show immediately the accident claim form properly filled. In case of theft the insurance coverages will not be applied if the client does not show the corresponding formal complaint within 24 hours as well as the stolen vehicle's keys. This insurance will be invalidated, and so will be the contract, losing the renter the amount of the rate, insurance and deposit when: A) the vehicle is driven by other person different from the renter; B) the driver breaks the laws of the traffic law; C)the damages are deliberately caused. D) the vehicle carries more passengers than authorized. E)the vehicle is driven outside the road. F) the driver drives under the influence of alcohol and other drugs. G) the renter uses it for any activity, like shipping, remunerated transport of passengers or when it implies directly or undirectly sublease of the vehicle. When the insurance is invalidated for the aforementioned causes (A to G) the renter is responsible for the damages caused to the vehicle due to theft, accident, breakdown, vandalism, misplacement or loss of its pieces, as well as for the days the vehicle is not running. 3º REPAIRS. The lessor will not pay the cost of the repair which is done by people lacking from written authorization, and will not be responsible of any agreement between the renter and a third party. In case of breakdown the company Autos Portmany, due to technical matters, will need a minimum delay to solve the problem, this delay is estimated in 5 hours, during office opening hours. 4º RETURNING THE VEHICLE. The client must return the vehicle in the agreed place and delay. The service will only be considered finished when the car and its keys have been returned to the lessor. If the vehicle is returned before, the renter will have no right to a refund of the rate and insurance of the contract. In the event that the renter wants to keep the rented vehicle for a longer period than agreed in the contract, he must obtain previous written authorization by the lessor, to whom he must pay the corresponding rate or accept the charge in the credit card with which he has paid the rental, under no circumstance can the deposit be used to extend the rental period. There is a 29-minute courtesy period, after which an additional charge for the extra hours or day (after two hours) will be made. The non-fulfilment of these conditions authorizes the lessor to take charge of the vehicle or require it through the courts. 5º MINIMUM RENTAL PERIOD. From any time of the day until 19.30 of the same day. It is closed from 12.30 until 17.00 and from 19.30 until 09.00. The vehicle cannot be taken out of the isle of IBIZA without written authorization. 6º FUEL AND FINES. They must be paid by the renter. If the client fills up the vehicle with the wrong kind of fuel he will pay for the repair and/or movement costs. The client undertakes to return the vehicle with the same amount of fuel than when picking it up. If the client returns the car with more fuel in the tank than when he picked the vehicle up, he will receive no refund due to administrative issues. 7º EXTRA CHARGES. The lesser authorizes the renter to charge in his credit or debit card all the extra charges derived from the return of the vehicle, according to the clauses in this rental contract. 8º JURISDICTION. In case of lawsuit deriving from this contract, both parts agree to submit themselves to the courts of IBIZA, expressly waiving any other jurisdiction. There might be mistakes in the translation, for the purposes of the contract, both parts submit by the conditions written in Spanish. I accept the terms and conditions set up in this contract.
